Probate sales

Selling a Home Through Probate.

Probate is the court-supervised process of settling a person’s estate. When real estate is part of that estate, the property often needs to be sold — and the steps can look different from an ordinary sale. We guide executors, administrators and families through the real estate side while working alongside your attorney.

Who this is for

  • Executors or administrators named in a will or appointed by the court
  • Families who have not opened probate yet and are unsure where to start
  • Heirs who inherited a property with belongings still inside
  • Out-of-area representatives who need local help with the property

Full authority vs. limited authority

California personal representatives are usually granted either full or limited authority under the Independent Administration of Estates Act. Full authority generally allows a sale with notice to interested parties, while limited authority typically requires the court to confirm the sale. Your attorney determines which applies; we prepare the property and the marketing plan accordingly.

What a court-confirmed sale involves

In a court-confirmed sale, an accepted offer is presented at a hearing where other buyers may be permitted to bid. That means extra notice, specific timing and a buyer who understands the process. We market the property with these requirements in mind and keep everyone informed.

Valuation and documentation

Estates often need a clear picture of value for the file and for family decision-making. We provide a free written market analysis based on comparable sales and property condition. This is a market analysis, not an appraisal — a probate referee or licensed appraiser handles formal appraised values.

Belongings, repairs and condition

Many probate homes are sold with personal property still inside and deferred maintenance. We can help coordinate cleanout, donation and disposal, and can discuss whether light preparation makes sense. Options may be available for certain costs to be handled at closing.

Selling as-is

Estates frequently sell as-is. That does not remove disclosure responsibilities, but it does reduce the work required from the representative. We help you weigh an as-is sale against preparing the property, using real numbers for your market.

Working with your attorney

We stay in our lane: the real estate. We coordinate with the probate attorney on timing, notices, signatures and closing so the property side keeps moving without adding to your workload.
